Terms & Conditions — “First Payment Wins” promotion for BookdiaFork Scale Premium subscription

1. Promoter

The promotion is organised by BookdiaFork of Beverly Vacanze, based in Rome (the “Promoter”).

2. Promotion period

The promotion runs from 01/06/2026 at 00:00 (CET) until 30/06/2026 at 23:59 (CET), unless the prize is exhausted earlier or the Promoter announces an extension.

3. Eligible participants and participation requirement

The promotion is open to restaurants/businesses operating anywhere in the world that make a new paid annual subscription to the BookdiaFork Scale Premium plan on the official website or through authorised commercial channels of the Promoter during the promotional period. Trial subscriptions, renewals and conversions of already active plans are excluded. Participation is subject to compliance with applicable local laws in the participant’s country of residence/operation.

4. Mechanics and prize award

- The prize is a travel/sporting-event package for 2 people worth up to €3,000 (voucher/back‑credit to be used with the contracted supplier).

- The prize will be awarded exclusively to the first order for which the Promoter verifies receipt of payment (the “First Verified Payment”).

- “First Verified Payment” means the order with the oldest timestamp for which the Promoter has received and verified the actual payment credit (for bank transfers: date of credit to the Promoter’s account; for card/POS: confirmed authorisation/transaction).

5. Confirmation procedure and timing

- Upon completion of the order the customer will receive an email confirmation with order ID and timestamp.

- Administrative and accounting verification may take up to 7 (seven) business days from the order time. The Promoter will inform the customer of the result by email within 3 (three) business days of completion of the verification.

- If the chronologically first order does not pass verification (e.g. payment not received, missing data, KYC not completed within 7 days), the prize will be awarded to the next chronologically subsequent order that is verified.

6. KYC requirements and documentation

On request by the Promoter, the customer must provide a copy of the contact person’s identity document, business registry extract (or equivalent) and any information necessary to verify eligibility. Failure to provide requested documentation within the specified time will result in exclusion from the promotion.

7. Prize delivery method

- The prize will be delivered in the form of a nominative voucher/back‑credit issued by the contracted supplier and managed according to the supplier’s terms and conditions.

- The voucher may be subject to blackout dates, availability limits and additional conditions (transport, personal expenses, airport taxes and extras not included). The winner will be informed of such conditions at the time of issue.

- The voucher must be used within 12 months from the date of issue, unless otherwise specified on the voucher.

8. Transferability and combinability

- The prize is nominative and not transferable except with prior written authorisation from the Promoter and the supplier.

- The prize cannot be combined with other promotions or discounts, unless otherwise authorised in writing by the Promoter.

9. Prize refund

No cash refund is available and the winner will not be entitled to convert the prize into cash, except where required by law or by the supplier’s policy.

10. Taxes and charges

Any taxes, duties, fees or charges related to prize use applicable in the winner’s country of residence/operation are the responsibility of the winner, unless otherwise required by law or specified by the supplier. The winner is responsible for verifying tax and customs obligations in their country.

11. Exclusions and abuse

The Promoter reserves the right to exclude any participant who engages in fraudulent conduct, manipulates the participation mechanism or otherwise breaches these terms.

12. Right of withdrawal and subscription cancellation

The subscription withdrawal rights are governed by BookdiaFork’s General Terms of Sale. Exercising the right of withdrawal or cancelling the subscription before payment/verification will void the participant’s eligibility for the promotion.

13. Liability and force majeure

- The Promoter is not liable for delays, technical malfunctions, service interruptions, lost emails, transmission errors or any inconvenience caused by force majeure, IT problems or third‑party acts that prevent correct execution of the promotion.

- Force majeure includes unforeseeable events beyond the Promoter’s control (e.g. natural disasters, strikes, public measures, external technical failures).

14. Personal data processing

- Personal data supplied by participants will be processed by the Promoter in accordance with Regulation (EU) 2016/679 (GDPR) for EU data subjects and, for participants outside the EU, in accordance with applicable local law and any safeguards adopted by the Promoter for international data transfers (e.g. standard contractual clauses). Data will be processed for purposes related to managing the promotion, awarding the prize and fulfilling legal obligations.

15. Publication of winner and use of name/image

- Unless prohibited by law or requested otherwise by the winner, by participating the winner authorises the Promoter to publish the winner’s and the business’s name for promotional purposes (e.g. website, social media, promotional materials).

- Requests for non‑publication must be sent in writing to the Promoter within 7 days of notification of the prize award.

16. Communications and complaints

- For information or complaints, participants may contact the Promoter by email at [contact email] or by post at [postal address].

- Complaints must be submitted within 30 days from the end of the promotion period and will be handled and responded to within 30 business days.

17. Changes and suspension of the promotion

The Promoter may modify, suspend or terminate the promotion in whole or in part for legitimate reasons, without prejudice to acquired rights. Any change will be promptly announced on the official website or by email to registered participants.

18. Governing law and jurisdiction

These terms are governed by Italian law. Any dispute arising from the interpretation or enforcement of these terms shall be subject to the exclusive jurisdiction of the Court of Rome, except where mandatory local law grants the participant a different forum.

19. Acceptance of the terms

Participation in the promotion implies full and unconditional acceptance of these terms and conditions.

20. Practical information and prize award timing

- The prize will be awarded within 30 days from verification of the winning order. The winner will be contacted by email at the address provided at purchase.

- If the winner cannot be reached within 30 days of the first notification, the Promoter may award the prize to the next eligible participant according to the rules above.
